A federal tax lien and an IRS levy are different collection tools. A lien is a legal claim against property; a levy takes property to satisfy a tax debt. Knowing which one your documents describe helps you ask the right questions and respond to the actual issue. The IRS explains that a federal tax lien arises after it assesses tax, sends a bill and the debt remains unpaid. A Notice of Federal Tax Lien alerts creditors to the government's claim. A lien can affect property and complicate borrowing or a sale. Do not assume that removing a public notice, releasing a lien and resolving the debt are interchangeable. The IRS describes separate procedures for lien release, withdrawal, discharge of specific property and subordination. Each has its own conditions. A levy permits seizure of property, including money in financial accounts or part of your wages. The IRS tells taxpayers receiving a Final Notice of Intent to Levy and Notice of Your Right to a Hearing to contact it right away. Read all deadlines and instructions in your notice. If a levy has already affected an account or paycheck, collect the levy documents and recent statements. A levy may qualify for release in certain situations, including immediate economic hardship or an error, but the facts matter and release does not automatically resolve the underlying tax debt. Start a file with the relevant tax years, notices, balances, returns and proof of payments. Note whether property is being sold or refinanced, whether wages or a bank account have been affected, and what deadlines are approaching. Ask a tax professional to explain the specific action, the available response and the records needed. Keep the discussion focused on your documents rather than on a general promise to remove every lien or stop every levy. Contact Trifecta Tax Relief to discuss an IRS collection matter.
